OneStopPros – Terms of Service
Welcome to OneStopPros (“OSP,” “we,” “our,” or “us”). By creating an account or using our platform, you (“Customer” or “Pro”) agree to the following Terms of Service. Please read carefully before using our services.
1. Account Registration
- You must be at least 18 years of age to create an account.
- All registration information must be truthful, accurate, and complete.
- You are responsible for maintaining the confidentiality of your login credentials.
- Accounts are personal and non-transferable. Misuse may result in suspension or termination.
2. Use of the Platform
- OSP is a marketplace that connects Customers (seeking services) with Pros (independent service providers).
- OSP does not perform or supervise the work and is not responsible for the quality, safety, or legality of services provided.
- All scheduling, communication, and payments must occur through the OSP platform.
- Users agree not to use the platform for fraudulent, unlawful, or abusive purposes.
3. Independent Contractors
- Pros are independent contractors and not employees of OSP.
- Pros are solely responsible for their own taxes, tools, materials, insurance, and compliance with laws.
- Customers are responsible for reviewing a Pro’s qualifications, licenses, and insurance where required.
4. Payments and Fees
- All payments must be processed through the OSP platform. Off-platform payments are prohibited.
- OSP may charge service or platform fees, disclosed at the time of booking.
- Attempts to bypass the platform for payments may result in account suspension or legal action.
- Refunds, if applicable, will only be processed through the original payment method.
5. Cancellations and Refunds
- Customers: Cancellations made less than 24 hours before the scheduled job may result in a cancellation fee.
- Pros: Cancellations without sufficient notice may result in penalties, reduced platform visibility, or suspension.
- Refund eligibility depends on timing and circumstances, as outlined in our Cancellation Policy.
6. Safety and Professional Conduct
- All users must act respectfully and professionally. Harassment, discrimination, and illegal activities are prohibited.
- Pros must provide services in a safe and workmanlike manner.
- Customers must provide a safe environment for Pros, including secure property access and removal of hazards.
- Drugs, alcohol, or unsafe practices are strictly forbidden during service performance.
7. Licenses, Insurance, and Compliance
- Pros must comply with all applicable laws, including licenses and permits required for their services.
- OSP does not verify or provide licenses or certifications.
- Customers should request proof of license or insurance when relevant.
8. Privacy and Data Protection
- OSP collects and uses personal data in accordance with our Privacy Policy.
- Users must not misuse or share another user’s personal information.
- Breaches of privacy may result in suspension and legal consequences.
- Data Collection: OSP may collect information such as name, contact details, payment information, identity verification documents, location data, and platform usage analytics.
- Purpose of Use: These details are used to facilitate bookings, process payments, prevent fraud, provide customer support, and improve our platform.
- Data Sharing: OSP may share necessary information with trusted service providers (e.g., payment processors, background check partners) strictly for operational purposes and in compliance with applicable laws.
- Data Retention and Deletion: We retain user data only as long as necessary to fulfill the purposes described above or as required by law. Users may request account deletion, after which most data will be securely deleted or anonymized.
- User Rights: Depending on jurisdiction, users may have rights to access, correct, or delete their personal data, and to opt out of promotional communications. Requests may be made through our support team.
- International Data Transfers: If data is transferred outside the user’s country, OSP ensures that adequate safeguards (such as secure servers and compliance with data protection laws) are in place.
9. Disputes and Liability
- OSP is not liable for damages, losses, injuries, or disputes arising from services performed.
- Customers and Pros should attempt to resolve disputes directly in good faith.
- If unresolved, disputes may be submitted to OSP for limited mediation, though OSP does not guarantee resolution.
- All disputes shall be resolved through binding arbitration, not through court litigation.
- Users in certain jurisdictions (such as California or the EU) may have additional rights under local laws (e.g., CCPA, GDPR).
10. Updates to Terms
- OSP may modify these Terms of Service at any time.
- Continued use of the platform after updates constitutes acceptance of the revised terms.
- Significant changes will be communicated via email or app notifications.
11. Termination of Use
- OSP reserves the right to suspend or terminate any account that violates these terms.
- Users may deactivate their account at any time, but outstanding fees or obligations remain enforceable.
- Upon termination, certain data may be retained as required by law or for legitimate business purposes.
